MSFA Sprinkler Trailer Request and Use Agreement

The Terms of this agreement are as follows:

  1. EQUIPMENT: The Maryland State Firefighters Association (“MSFA”) shall provide, to the Department, the fire sprinkler trailer (“Equipment”) and its contents for use at an event.
  2. DELIVERY: The MSFA shall deliver the Equipment to the location indicated above by the requested delivery date. The Department representative shall be on site to receive delivery.
  3. TERM OF USE: Equipment use will start on date listed below and will end on date listed below and will be available for pick up at time requested below.
  4. LOCATION: The Department will secure the Equipment at the designated location as indicated above. The Equipment is not to be moved from the designated location while in possession of the Department.
  5. SURRENDER OF EQUIPMENT: Department shall, at the expiration of the Term, surrender the Equipment to the MSFA in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the
  6. USE OF EQUIPMENT: Department shall only use the Equipment in a careful and proper manner and will comply with all laws, rules, ordinances, statutes and orders regarding the use, maintenance and storage of the
  7. BURN DEMONSTRATION: Shall be conducted by the department in a fashion that does not allow for excessive burning of the non-sprinklered compartment of the trailer. The fire will be extinguished with a properly placed and charged hose line before flashover occurs in this compartment.  This unit is not a flashover simulator and should not be put into harm’s way to demonstrate such.  The purpose of the trailer is to demonstrate an effective, rapid response sprinkler application, not the excessive advancement of an uncontrolled fire event.
  8. WATER CONTROL: Once the sprinklered compartment of the trailer is activated during the demonstration and the fire is properly extinguished, the water source is to be immediately shut off so as not to cause excessive water damage to the trailer or the contents of the compartment. This will allow for that furniture in this compartment to be used for a second demonstration where it will be moved to the non-sprinkled compartment for the next burn.
  9. TRAILER RETURN PREPARATIONS: Upon completion of the demonstration and before the trailer is scheduled for pick-up by the MSFA, the department will dispose of all of the burned furniture in the non-sprinklered compartment of the trailer and remove all of the sheetrock and nails in that compartment as well. The department is expected to dispose of the debris at their station and broom sweep and hose out the non-sprinklered section of the trailer.  The sprinklered compartment of the trailer can remain as is once the fire is properly extinguished and a thorough check for fire extension is completed.
  10. FAILURE TO COMPLETE THE POST-EVENT CLEAN-OUTS REQUIREMENTS: If not completed prior to pick-up by the MSFA, the department will not be offered the use of the trailer for any future events.
  11. INSPECTION: The Department representative shall inspect the Equipment and note any issues/damages upon delivery. The MSFA representative will inspect the Equipment upon pick-up and complete the post incident inspection report, noting any issues/damages in the presents of the Department representative.
  12. MAINTENANCE, DAMAGE AND LOSS: The Department will, at their sole expense, keep and maintain the Equipment clean and in good working order and repair during the Term. In the event the Equipment is lost or damaged beyond repair, Department shall pay the replacement cost of the Equipment; in addition, the obligations of this Agreement shall continue in full force and effect through the Term.
  13. OWNERSHIP: The Equipment is and shall remain the exclusive property of the MSFA.

  16. ENTIRE AGREEMENT: This Agreement constitutes the entire agreement between the Parties and supersedes any prior understanding or representation of any kind preceding the date of this Agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement. This Agreement may be modified in writing and must be signed by both the Department and the MSFA.
